Default Fence

If a lake has a fence (chain link) around it, but it has no posted signs, is it legal to fish? It's not far from my house, and the other day, as I was walking by it, I threw a chunk of bread in. Within thirty seconds that water was boiling with shiner, all over six inches. If anyone else here has ever fished for shiner, you know how you catch a million bream trying to get one. In this pond, no bream. I need input.

Well, if you have to climb over a fence then I would say that it is not OK to fish it. I recommend finding the owner and asking him if its so close.

It would seem than anyone who would go to the expense of putting a fence around a pond is sending a signal that he does not want anyone around the pond.

Well the thing is that its mostly ponds that are in neighborhoods or along the side of the road that the city or whoever constructed the area put the ponds there. No single person owns it so thats why he was asking.

seems like a retention pond to me. i always see them with fenses around them. most likly the city owns them

Yea, if the city owns it then they probably put the fence around it to eliminate the possibility of drownings and lawsuits. You can always ask, but if the city or any other type of govermental entity owns it then you might as well ask the wall.

I can't believe you even had to ask that qestion, if they took the time to put a fence around it then that usually means they don't want you near it! Seems pretty simple to me

Due to a large number of drownings most retention ponds and small ponds are required to have a fence around them if there is heavy foot traffic around them. This cuts down on frivolous lawsuits. Legally if its not posted you can still get yelled at but not arrested. 8)

You may want to check your state laws on that. Some states don't require any signs to restrict tresspassing. I believe Mississippi is one of them. If I'm wrong feel free to eduacate me. ;D

You are right. In Kansas if you go upon the property of another without expressed permission, it is called trespassing., which is a misdomeanor. If you go upon the property of another that is posted OR is enclosed within a fence, it is called CRIMINAL TRESPASS, which is a felony!

lota places back home are public ground(BLM) are fenced because its free range and cattle have to be controlled. so many fences no-one actually posts the whole lines they may post next to a road or gate and then every 50 feet or so youll see a fence post with the top painted orange. this also legally means no trespassing. course then ya get the rancher that runs cattle on public ground and paints/post the fenceline evan though he has no right to, but it works because most people just folow the rules and never ask.
best bet is a few hours spent researching who actually owns it and if it is private politley asking works alot of the time, especially if you dont abuse the area or piss of the owner ie littering vandalizing or damageing fences driving off the road etc.

Ya, I figured it had something to do with drownings, it is a retention pond that looks like it is owned by either a health center or the city. I checked the whole thing yesterday, no signs. It is not a regular sloping pond, it si like a box, with about a 6 inch ledge on the inside of the fence, so climing is out of the question, but I still think tthat I could stick a cane pole/flyrod through it (if legal). Thanks for the help (sorta) so far.

it may be best if ya just leave it unfished as great as it would seem. to risk court related problems is a un wise choice.

fish the lake as much as you like and just play stupid if anything happens

no seriously me and some of my friends used to sneak into breading ponds at night, the ponds was used to stock local lakes. Caught a $h#tload of bass!! Great fun! must do it at least once while your young!

A while back a buddy and I would sneak into ponds during the early morn (before daylight) or the late eve.(after daylight). The owners never knew until a dog barked or someone said "hey you" !
We had a good time doing it due to the fact that we were sneaking into someones pond that we hadn't nor would ever get permission to fish.
Fished in one pond and we caught quite a few. We would just "pitch the bass" up on the bank and when we "had" to leave, we would gather 'em up and put them in a cooler. Thats one of the times when the dog barked !
NOTE: It's easier for two people to sneak into a pond than for one person. If I watch your back then you can watch mine.
1. Wear dark colored clothing
2. Know what your going to use for bait, and carry it in your pocket.
3.Only carry one (1) rod.
4.Walk slowly as not to give away your position.
5.In the event you hear someone, then get the hell outa there.

Well bassnman you should be proud, your a loser :-/. You couldn't get permission so you tresspassed. Where I live that is just asking to get shot . So feel proud buddy, and maybe grow a set and ask for permission to fish next time.

Â*Ya'll must be really thick. It was a humorus statement.
Actually, while I was on a logging site, we DID get permission but she told us that she didn't normally didn't allow people to fish in her pond.
Â*She told us that if to try and fish prior to daylight. That way other people wouldn't see us out there at her pond. Of the people that she turned down, some were in here own neiborhood and they apparently had a problem with leaving trash as well as taking every fish that they would catch.
You guys don't know me , so quit trying to "slam" me on this net.
