Default Hey Va. Drivers

My son calls and says he got a speeding ticket in Va. It was for 78 in a 55. Does he have to go to court now for wreckless op instead of speeding? He lives in fla and wants to just pay the fine or get a lawyer, but may have to appear...any locals know of a way out? thanks

He'd probably take get his licenses taken away for a wile. I don't think that he would have to go to court than fully, possibly divers ed. tho.

JB did he get charged with wreckless driving? I'll try to make some calls tomorrow and find some info for ya

I'm pretty sure that for wreckless driving he has to appear in court but I'll check around.

VA is real bad, my brother got one there last year coming down a hill going only about 10 over. Up here if you ain't going 80 you'll get run over.

the cop only took five minutes to write a ticket and politely said over twenty over is not only speeding, but considered wreckless op. My son asked if he could be charged with nineteen instead of twenty three mph over LOL
didn't work

Not sure that is up to each locallity. But I do know a buddy of mine told me since all the budjet cuts tickets are a great revanue for small towns so if you get pulled over lookout you are getting a ticket.

Google "Code of Virginia" and you'll find all the laws. There are three reckless charges and depending on which one he was charged with will determine if he stands a chance. One is rediculous because there is no way to put up a legal defense against it but they normally reduce it to improper driving if you show up and dispute it. I believe 20 over the speed limit will get you a reckless charge.
Reckless can get you 1 year and up to $2500. You may want to tell him to show up and fight it.

Not that I've been charged any time recently or anything......

Does the ticket show wreckless operation or just speeding? Seems like when you call to get the fine, they would tell you the charge and price of each, if the officer charged him with both.

They put the code # on the ticket. All you need to do is look it up online.

my family is in law enforcement, if you go to court and your son says that he was not driving as fast as the officer indicated they will ask him if he was speeding....his answer should be "yes", but that he wasn't going as fast as his ticket indicated...the cops can't prove it..and trust me more than half the time their radars don't work or they don't even have them on...here in Maine if your officer doesn't show up to dispute the charge you get off scott free...I know a lot of state's have mediator's or representatives of the officer that appear on the officer's behalf....it's a pain the arse if your a cop in Maine 'cause you are constantly gettin called by the courts to go and dispute tickets and who wants to do that on your day off

In VA their day in court is a day of work so they will be there.

I know someone who was charged with doing 104 in a 45 and did a week in jail. He claimed that there was something wrong with the radar because he and two other witnesses swore that he was doing 65. A police officer friend and I had a discussion and he said that the radar was correct and it rarely if ever fails or makes a mistake. And then he said it works just like my sonar unit on my boat..........
